Hiring, Renting, and Lease: Ruling on Tenant Demanding Sarqoflī Without Transfer Rights After Lease Expiry
English:
Question #1654:
If the landlord declines to renew the lease, is it permissible for the tenant, who rented a shop for a given period, to refuse to vacate the shop unless he is paid a sarqoflī? And is it permissible for him to claim the right of sarqoflī, especially when he has no right to transfer the lease to a third party?
Answer #1654:
The tenant has no right to remain in the property and refuse to hand it over to the landlord after the expiry of the lease. However, it is permissible for him to demand a sarqoflī from the landlord if he has such right by virtue of acquiring it from the landlord or by law.
