Question #961:
A person owns property consisting of two floors. He lives on the upper floor while giving the lower part to another person to live in. The owner takes some money from that person in the form of a loan and does not charge the tenant at all. Would this borrowed amount be liable to khums?

There is no shar‘ī reason for offering free use of the house for a loan acquired from the tenant. In any case, the borrowed money is not subject to khums.
