Endowment: Who Is Eligible to Elect Trustees in an Endowment?
English:
Question #2013:
In an endowment deed, the following provision was made, “There should be an elected board of trustees from the people”. Does this phrase indicate who the electors should be? However, assuming that this is not the case, who should be eligible to elect the trustees?
Answer #2013:
Apparently the said phrase means that the public must take part in the election of the board of trustees. In any rate, if the endower has not specified the elector/s in his endowment deed, then, if it has a certain trustee, he appoints the board of trustees. If it has several specific trustees who are not in agreement or the endower has not specified any trustee, they refer to ḥākim of shar ‘ in this regard.
