Endowment: Converting Adjacent Trust Land into a Graveyard
English:
Question #2019:
A piece of land, which is held in trust, is adjacent to a cemetery. The cemetery has no more space to accommodate more graves. The site of the land makes it ideal to be annexed to the graveyard. Is it permissible to go ahead and turn it into a graveyard?
Answer #2019:
It is not permissible to change the use of the land that is held in trust to that of a graveyard if it was originally dedicated to some other use. However, if it was held in trust so that the proceeds are to be spent for a purpose, there is no objection to leasing it from its shar‘ī trustee for the purpose of using it as a burial ground. That is, if the trustee is of the opinion that it is in the best interest of the trust.
