Is it obligatory to hand over children’s property, which they inherited, to the grandfather as their shar‘ī guardian? And suppose it is obligatory, where would the children and their mother live and who is going to feed them, especially when they are still attending school or are minors and their mother is just a housewife?
Answer #1503:
The guardianship over children does not mean handing their property over to the guardian and denying them having access to it until they have attained ritual maturity. It means that the guardian acts as the supervisor over the children and their property to keep their property and that any involvement in their property needs his permission. It is incumbent on him to spend their own money proportionate to their needs. Should he see it fit to put the property at their disposal and that of their mother, he has every right to do so.
